'Alien detention'

Immigrants may be deprived of their liberty either at the border (possibly after an unsuccessful asylum application) or whilst in the Netherlands if they have entered illegally and are without a residence permit. In both cases detention is a precursor to transferring the individuals back to their country of origin.

The IND must establish a person's identity and nationality before they can be expelled, which can be difficult for them and often holds up the process. In such cases our work is to monitor the proceedings closely to ensure that the IND is taking all necessary steps and to ensure that the individual is is released if the IND fails to meet its obligations.
